Code of Conduct 2026 RFP

This document establishes the Code of Conduct for OG&E's 2026 competitive bidding processes in compliance with Oklahoma Corporation Commission rules (OAC 165:35-34). The code of conduct outlines governance requirements for electric utilities that intend to submit their own self-bids in competitive solicitations, ensuring fairness and transparency in the bidding and evaluation processes.

Key Requirements: OG&E shall publicly disclose the names and titles of members of its Bid Team, which develops the utility's own bid and does not participate in bid evaluation or selection. Similarly, the company shall publicly disclose the Evaluation Team members who evaluate bids and select the successful bidder, with this team having no involvement in developing the utility's own bid. Strict communication prohibitions are implemented to prevent any communications between Bid Team and Evaluation Team members regarding the RFP or competitive bidding process, except through open and transparent channels such as public technical conferences or Q&A processes available to all bidders.

Bid Team Composition: The Bid Team consists of 15 members including VP of Major Capital Projects Robert Burch, Directors Chris Lelak (Capital Projects) and Tony Shook (Power Plant Operations), plant director Andy Chancellor, and various senior engineers and project managers responsible for developing competitive bids.

Evaluation Team Composition: The Evaluation Team comprises 18 members including Matt Schuermann (VP, Power Supply Operations), Directors Brian Huckabay (System Planning), Kelly Riley (Resource Planning), and Dusty Nimmo (Supply Chain), along with various senior planners, engineers, and managers responsible for evaluating and selecting winning bids. Outside consultants and attorneys may assist both teams, but individuals cannot serve both teams simultaneously, and consulting firms must maintain strict separation between team-specific individuals.
