Each bidder must submit a Notice of Intent to Bid by April 8, 2026, execute a Mutual Nondisclosure Agreement prior to bid submission, and include a Bid Summary Form and redlined Capacity Purchase Agreement (CPA). Bidders offering existing generation facilities must provide the most recent SPP Deliverability Study results. Projects requiring Effective Load Carrying Capability (ELCC) accreditation must provide the most recent ELCC Study Results from SPP, and projects utilizing Performance Based Accreditation (PBA) must provide four years of historical Equivalent Forced Outage Rate demand (EFORd) data from the NERC GADS system.

Bid evaluation consists of three components: Threshold Evaluation to ensure compliance with RFP requirements and inclusion of all necessary documentation; Non-Price (Qualitative) Evaluation worth 15% in aggregate, comprised of Contract Risks, Costs, and Benefits (5%) and Capacity Security Risk (10%); and Price (Quantitative) Evaluation worth 85%. Bids must remain valid through the entire evaluation period and any resulting regulatory proceedings. OG&E reserves the right to reject any proposal regardless of price and may select one or multiple bids that address its needs. Disputes will be governed by Oklahoma law with exclusive jurisdiction in Oklahoma County courts.
